PROCEDURE: The property will be sold on a
price per acre basis with the per acre bidding:
total purchase price per tract being calculated
by multiplying the buyer's bid by the acres on
the tract(s) purchased. The property is offered
in three tracts and sold by choice. The highest
bidder will have the option to take Tract 1,
Tract 2, Tract 3 or any combination of them for
the bid price per acre. If the first highest
bidder takes all tracts, the auction is over.
Any tracts not purchased by the highest bidder
shall be offered separately. Final acreage used
for calculating the sale price shall be
determined as follows: 1) If all three tracts
are sold to the first highest bidder at the
first high est bid, the total price shall be
based upon the estimated
acreage (760.40) X the per acre bid price. 2)
Or, if all three tracts are not sold to the
first highest bidder at the first highest bid,
the price shall be based upon surveyed acreage
for each tract, as reflected in a survey to be
provided by the Seller. MINERALS: All mineral rights owned by the
sellers, if any, will be conveyed to the buyers. CONDITIONS: All property is being sold on
an "as-is where is" basis with no
warranties or guarantees, expressed or implied,
made by the auctioneer, seller or seller's
agent. All inspections are the responsibility of
the buyers and at the buyer's expense. POSSESSION: Possession will be granted at
closing, on or before March 5, 2012. EARNEST PAYMENT: A 10% earnest money
payment is required on the day of the auction.
The earnest money may be made in the form of a
check or cash. The earnest funds will be held
with the closing agent which will be Moentmann
Abstract and Tit le Company. Your bidding and
this sale are not subject to buyer financing, so
buyer financing must be arranged prior to the
auction. If the buyer f ails to close the
transaction, the earnest money payment shall be
paid to the Seller as liquidated damages, it
being agreed that actual damages are difficult,
if not impossible, to ascertain. CONTRACT & TITLE : The sale is
subject to all easements, covenants, and
restrictions of record. Directly upon the
conclusion of the auction, the high bidders will
enter into a real estate contract for the
purchase, and tender the Earnest Payment for
deposit with the closing agent, Moentmann

provide title insurance from Moentmann Abstract
and Title Company at their expense. A copy of
the real estate contract will be available for
inspection prior to the auction. The title to be
conveyed by Seller s hall contain the exceptions
listed in a Title Insurance Commitment, which
will be available for inspection prior to the
auction. The successful bidder shall be deemed
to have accepted the terms and conditions set
forth in the Real Estate Contract and the title
to be conveyed by Seller, with the exceptions
noted in the Title Insurance Commitment. REAL ESTATE TAXES: 2012 real estate taxes
will be the responsibility of the buyer. CLOSING: The closing date for all tracts
