It is with great pleasure that Wheeler Auctions has been entrusted to liquidate the home and land holdings of the late Phillip K. and Velda Lee Kelley.
This property has been in the Kelley Family over 116 years and represents one of the great farmers and farms of Cass County. It is in a prime location just east of Harrisonville and many of you have driven by the property (corner of Blinker Light Road and HWY 2) over the years with the thought that someday I would sure like to have all or a part of that place. On February 23, 2024 you will have that opportunity, so we invite you to be with us on sale day to exercise your option to bid on and buy all or part of this historic farm. Phillip Kohler Kelley Trust Estate
Phillip Kohler Kelley and his twin sister, Margaret Cecelia Kelley, were born Sept. 14, 1931, to Phillip K. and Velma Lee (Kohler) Kelley. The Kelley family made their home on farm ground homesteaded by Velma’s family on top of Kohler Hill. Phillip and Margaret both grew up there and even rode the same horse across the farm to school.
From a young age, Phillip loved taking care of his cattle. After high school, he served in the Army from 1952 to 1954 and married Velda Lee Kircher on March 28, 1954. The couple lived near Lone Tree, Mo., and in Archie, Mo., but built their current home in 2000 on top of Thrill Hill near Harrisonville, Mo.
Phillip’s sister, Margaret, married Dennis “Mac” Fox and spent her career working as a computer programmer at Baptist Medical Center in Kansas City, Mo. Margaret and Mac had one son, Tim Fox, who resides with his wife, Carolyn, in New York City, N.Y. They have one son, Sam.
Phillip was a familiar face in town, often visiting the banks, restaurants and stores. He loved attending area auctions, visiting with friends and bidding on items to add to his collections.
But Phillip was particularly proud that the 233 acres he called home was named a Missouri Century Farm in 2008 during his ownership. Even at 91 years old, he had more than 50 head of cattle on the property and in spite of several health challenges in his later years, he found a way to take care of his cattle and the farm he loved every day.

We will offer this tract in the third and final position of our Kelley land auction. It will be sold by the whole dollar amount and will be sold following the offering of the Tract 2 and Tract 3 farm land tracts.
Tract 2 and Tract 3 contain a total of 228.93 surveyed Acres with approximately 180 open tillable acres currently in row crops, pasture and hay ground. FSA has 105.64 acres in row crops with the balance, much of it terraced, in pasture and hay
This 33.95 surveyed acre land tract consists of open farm ground with development possibilities as it has road frontage along both HWY 2 and Blinker Light Road. Home sites, mini farms, or developmental property of this size is very hard to come by and with this location, a priority and look into the future makes this a very interesting tract of Cass County land.
This 194.98 surveyed acres has all of the current FSA row crop acres contained in this tract. A total of 8 machine sheds and cattle barns are maintained in the NE corner of Tract 3. These buildings are mostly good to excellent condition and range in size from 30’x24’ to 40’x60’ in size. Note the pictures and when you view the farm be sure to look thru those farm structures. Water for cattle is abundant with both pond access and stock water available. Access to those buildings is thru the ingress/egress easement along Hwy 2 or thru the driveway where easement access will be in place at the farm house adjacent to the NE corner of Tract 3.
Method & Order of Auction: We will offer the land tracts, Tract 2 of 33.95 acres and Tract 3 of 194.98 acres using the Choice Method of Auction where the high bidder will have his choice of either Tract 2 or Tract 3 with the option to take both tracts at the bid price. The land tracts sell by the dollar value per acre with the surveyed acres in each tract used as the multiplier to determine the final selling price of each tract. If the high bidder only chooses one of the tracts then we will open the bidding on the remaining tract. When the selling price and buyer or buyers of those two tracts are established then we will offer Tract 1, the home and 5 surveyed acres. This tract will sell by the whole dollar amount to establish its selling price. This land sale is not contingent on any financing needed by a buyer to close the transactions. Make sure you have your financing, if needed, in order prior to bidding or buying any of these tracts. Property sells with the confirmation of the bid price by the sellers. This will be a live onsite auction with internet bidding available through WheelerLive. Internet bidders must be preapproved 24 hours prior to the auction.
Contract: Immediately following the conclusion of the Real Estate Sale, we will write, sign, and receive the escrow/earnest money of 10% down Payment. Payment check is non-refundable and payable to Coffelt Land Title Inc.
Escrow/Down Payment: Upon execution of the Land Sale Contracts, the purchaser will pay by check and not in cash an amount equal to ten percent (10%) of the purchase price as earnest money made payable to Coffelt Land Title Inc., as escrow agent for delivery to the seller at the time of closing. The balance of the purchase price shall be paid by the purchaser to the seller at closing. Purchaser acknowledges and understands that the agreement between buyer and seller is not contingent upon financing and that failure to close this transaction on or before Friday, March 29, 2024 due to any delay caused by the purchaser shall constitute a forfeiture of the earnest money.
Closing: The closing of these transactions has been established to be on or before Friday, March 29 at the office of Coffelt Land Title Inc., 401 S. Lexington St, Harrisonville, MO 64701
Tenant/Possession: There is no 2024 tenant agreement in place for the home tract or any of the crop, pasture, or hay ground in Tracts 2 and 3. Possession on Tract 1, the home tract, is granted at closing.
Immediate possession will be granted for Tract 2 and or Tract 3, if in fact they are to be used for farming purposes so that a farmer can have the time needed to prepare for 2024 farming activities prior to closing. This immediate tenancy only applies if Tract 2 or Tract 3 is to be used for farming purposes. Any and all developmental or building projects must wait until closing to assume possession on either Tract 2 or Tract 3.
Taxes: The 2024 Taxes will be prorated to the day of closing. The 2023 taxes are paid and consisted of
Tract 1, @ $4,679.52 and Tracts 2 and 3 totaling $1,387.64. With new surveyed boundaries in place for this land transaction the Cass County Assessor may establish new and different tax assements for the property in 2024.
Utilities: Osage Valley Electric, Butler, MO has a meter at the home on Tract 1 and at a pole near the buildings located in the North East corner of Tract 3. No electric meter is in place on Tract 2.
Water: Public Water Supply District #9, Harrisonville, MO has a meter for the home Tract 1 and at the farm buildings on Tract 3. No water meter is in place on Tract 2.
Schools: The property is in the Harrisonville R-9 School District
Down Payment: Ten percent (10%) nonrefundable down payment the day of auction, upon signing a purchase agreement immediately following the close of bidding. The down payment may be paid in the form of personal check, business check, or cashiers check. The remainder of the purchase price is payable at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING. Be sure you have arranged financing, if needed, and are capable of paying the balance at closing.
Title: Sellers shall provide and execute a proper deed conveying the real estate to the buyer(s). Seller to pay for title insurance premium including title search and examination fees. Buyer to pay any lender fees, search premiums, or appraisals necessary to secure buyers funds for closing. Buyer and seller will split the closing costs.
Mineral Rights: The sale shall include 100% of the mineral rights owned by the sellers.
Easements: Standard Utility, Roadway, and Water easements will be in place on the three tracts. A recorded road safety ingress/egress easement for access to HWY 2 will be in place for the neighboring home adjacent to the Northeast corner of Tract 3. The land within that easement is part of Tract 3. In addition to the road entrance safety it affords the home, it also offers the purchaser safe access to that side or portion of Tract 3 for implements, trucks, etc.
Acreage/Survey: The entire property has been surveyed and legal descriptions are in place for each tract. The selling price based on the surveyed acres will serve as the multipliers to establish the final selling price of Tract 2 and Tract 3. Legal descriptions represented in the surveys are final and in some cases, fence lines or property corners may not coincide exactly with the surveyed deed lines.
