The draws and timber, especially the old Missouri Pacific Railroad line that borders the property on the West and South offers quality deer hunting.

Method of Auction: Tract 1, the farm, will sell by the dollar value per acre times 129.53 acres m/l to determine the final selling price. Tract 2 consisting of the Home on 3.67 surveyed acres will sell by the whole dollar amount. We will not tie the two tracts together in any bidding process. If you wish to buy both tracts, you need to be the high bidder on each tract. Property sells with the confirmation of bid price by the seller.
Contract: Immediately following the conclusion of the land sale, we will write the sale contracts and receive the escrow earnest money of 10% down payment. Payment check is non-refundable and payable to Truman Title Company, LLC.

Tract 1 Tenancy & Possession: There are no tenant agreements in place for the farm ground for 2023; however, the two tenants for the crop ground and hay ground would like to submit proposals to the new buyer to continue farming this land in the event that a non-farmer entity purchases the land. Other farmers in the area would like to rent the ground as well. Immediate possession is available on Tract 1 once the crops have been harvested. Hunting rights are granted (to the Buyer only) upon signing of the contract. Seller is not responsible for accidents.
Tract 2 Tenancy & Possession: The tenant in the home on Tract 2 has tenant rights until January 31, 2023. Possession may take place on February 1, 2023. Earlier possession will be granted if the current home tenant is able to vacate earlier.
Taxes: The 2022 taxes will be paid by the sellers. The total taxes for 2021 were $1610.07. The break-down is, home area was $1144.96, the farm totaled $358.67, and the 1 acre of pasture inside the Higginsville city limits was $106.44. 2023 taxes and beyond will be paid by the new buyer or buyers.
Utilities: West Central Electric services the Home on Tract 2. There are no utilities to the farm on Tract 1. There is no meter for the Tract 1 in place, however, utilities can be accessed from Highway T. In the event the same buyer purchases Tract 1 and Tract 2, then utility lines may be run from the meter on Tract 2 to service the farm as needed.
Water Rural Water District #2 services the home on Tract 2. There is no water meter or lines in place for water on Tract 1. There is water access from Highway T, however, a meter and line would need to be installed for the access.
Note: A water line does exist from the house to a stock waterer in the cattle lot on Tract 1, however, it is not in use and can only be turned on from the house. In the event water is needed for Tract 1, any agreement for rural water would be between the owners of Tract 1 and Tract 2.
Schools: Lafayette County C-1 School District
Down Payment: Ten percent (10%) nonrefundable down payment the day of auction, upon signing a purchase agreement immediately following the close of bidding. The down payment may be paid in he form of personal check, business check, or cashiers check. The remainder of the purchase price is payable at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING. Be sure you have arranged financing, if needed, and are capable of paying the balance at closing.
Title: Sellers shall provide and execute a proper deed conveying the real estate to the buyer(s). Seller to pay for title insurance premium including title search and examination fees. Buyer to pay any lender fees, search premiums, or appraisals necessary to secure buyers funds for closing. Buyer and seller will split the closing costs.
Mineral Rights: The sale shall include 100% of the mineral rights owned by the sellers.
Easements: Sale of the property is subject to any and all easements of record.
Acreage/Survey: Tract 1 consists of 129.53 acres m/l. All acreages are approximate and accurate to the best of our ability using assessors maps, measurements, and legal descriptions. The selling price based on the acreage multipliers is final and no future adjustments in sale price will be granted to either the buyer or seller of said acreage or Tracts. Any need for a survey to close this agreement is at the sole discretion of the Seller. Any need for a survey by the Purchaser, to acquire funding or close this agreement will be paid for by the Purchaser.
Tract 2 consists of 3.67 surveyed acres.
