Consisting of 71 Acres M/L with FSA reported acreage of 64.82 tillable, currently in hay production. The tract is tiled, terraced, and lays extremely well along HWY 13 and NE JC Penny Drive. Large equipment can easily access the farm along its Southeast property line.
The home is a one story frame home with 960 square feet on the main floor as well as 960 in the finished basement. Location: 1 ½ Mile North of Hamilton, MO on HWY 13. Property is bordered on the south along NE JC Penny Drive. The homes and farmsteads in a small section of real estate along JC Penny drive are not included in this land transaction. (See the Tract Map)
Method of Auction: We will offer Tract 1 consisting or 72 acres m/l of farm ground with home and two outbuildings in the whole dollar amount. We will offer Tract 2 consisting of 31 acres m/l of open farm ground by the whole dollar amount.
Contract: We will write the land sale contracts immediately following the conclusion of the real estate auction.
Down Payment: A 10% non-refundable escrow down payment will be required at the contract signing and made payable to the Caldwell County Abstract and Title Co.
Possession: Immediate possession will be granted to the buyer for the farm ground use for both Tract 1 and
Tract 2. Possession of the home on Tract 1 will be granted at closing.
Tenant: There is no tenant agreement in place for 2021. The current tenant would like to submit a proposal to the new buyer to continue farming this land in the event that a non-farmer entity purchases the ground. Other farmers in the area would like to rent this ground as well.

AUCTION TERMS AND CONDITIONS
Down Payment: Ten percent (10%) nonrefundable down payment the day of auction, upon signing a purchase agreement immediately following the close of bidding. The down payment may be paid in the form of personal check, business check, or cashiers check. The remainder of the purchase price is payable at closing on or before Tuesday, June 15, 2021. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING. Be sure you have arranged financing, if needed, and are capable of paying the balance at closing.
Title: Seller shall provide and execute a proper deed conveying the real estate to the buyer(s). Seller to pay for title insurance. Buyer and seller will split the closing costs.
Real Estate Taxes: The 2021 taxes will be prorated to the date of closing.
Acreage/Survey: Acreages are estimated using legal descriptions and aerial maps. The two parcels sell by the whole dollar amount, NOT by the acre.
Mineral Rights: The sale of the property shall include 100% of the mineral rights owned by the seller.
